2024-02. FY 2024 Budget Modification #2

A Budget Resolution of the Upper Mattaponi Tribe Council modifying the Annual Budget of the Tribe for Fiscal Year 2024; providing short title; describing purpose; making findings; adopting an amended budget; and providing an effective date.

WHEREAS, The Upper Mattaponi Tribe Council (the "Council") is vested with the authority to enact Budget Resolutions for the purpose of passing an Annual Budget or Budget Modifications by Article VII, Section 4(c) of the Constitution of the Upper Mattaponi Tribe; and

WHEREAS, The Council now finds that, due to a surplus of expected revenues, it is both necessary and expedient to modify the Annual Budget for Fiscal Year 2024;

NOW, THEREFORE, BE IT RESOLVED:

Section 1. Short Title.

This Budget Resolution shall be known and may be cited as "FY 2024 Budget Modification #2"

Section 2. Purpose.

The purpose of this Budget Resolution is to account for and appropriate certain revenues received in excess of the amounts forecasted in the Annual Budget for FY 2024 was initially enacted

Section 3. Findings.

The Council hereby finds and decares as follows:

A. The Council is vested with the power to enact Budget Resolutions for the purpose of passing an Annual Budget or Budget Modifications by Article VII, Section 4(c) of the Constitution of the Upper Mattaponi Tribe.

B. The Council is vested with the power to raise revenues and appropriate funds for expenditure by Article VII, Section 4(b) of the Constitution of the Upper Mattaponi Tribe.

C. The Tribe has received revenue in excess of the amounts forecasted in the Annual Budget for Fiscal Year 2024.

D. It is now necessary and expedient to enact a Budget Modification to account for an appropriate said excess revenues.

Section 4. Adoption and Approval.

This Council hereby adopts and approves the Budget Modification attached hereto

Section 5. Effective Date.

The Budget Resolution shall be in force and of effect immediately from and after its passage and approval according to law

The foregoing Resolution was duly voted upon by the Council on the 22 day of June, 2024, at a Regular Meeting with a vote of 5 in favor and 0 opposed, 0 abstaining, and 2 absent, pursuant to the authority vested in the Council by the Constitution of the Tribe.
